MAPQUO LLC · LEGAL
Terms of Service
Effective: September 1, 2026 · Last updated: October 10, 2026
These Terms explain how homeowners and contractors may use Mapquo's instant paving estimate software and establish the important distinction between preliminary software-generated estimates and a contractor's final construction proposal.
1. Acceptance and eligibility
These Terms govern use of mapquo.com, contractor-specific quote pages, property measurement tools, preliminary estimates, and related services offered by Mapquo LLC (“Mapquo,” “we,” “us”). By using the services, you agree to these Terms. Where affirmative agreement is required, we may request it in the applicable workflow. You must be at least 18 or otherwise have legal capacity to enter an agreement. If you do not agree, do not use the services.
2. What Mapquo provides
Mapquo provides software for collecting project details, approximate driveway and pavement measurements, and preliminary estimates using information and pricing settings provided by independent contractors. Mapquo is not a paving contractor, engineer, surveyor, or property inspection service. We do not perform construction work or enter homeowner construction contracts by generating estimates.
3. Measurements are approximate
User-plotted boundaries, satellite or mapping information, coordinates, and calculated square footage are preliminary and may be incomplete, outdated, or incorrect. Shadows, obstructions, surface curves, sloping land, placement of points, and conditions not visible on the map can affect accuracy. Measurements are not legal surveys, boundary determinations, engineering opinions, or guaranteed material quantities. On-site verification is required before relying on measurements for final project decisions.
4. Estimates are not final offers
Estimates are informational and reflect selected services, user-supplied information, measured area, and contractor-entered rates and pricing ranges. Final costs may change due to excavation, pavement condition, drainage, access, material requirements, labor costs, permits, additional work, or other conditions.
Unless the independent contractor explicitly agrees otherwise in a separate written arrangement, an automated Mapquo estimate is not a binding bid, guaranteed price, agreement to perform work, or promise of availability. The contractor controls its final proposal, job acceptance, and contract with the homeowner.
5. Contractors are independent
Contractors using Mapquo are independent third parties. Mapquo does not supervise or guarantee contractor licensing, insurance, skill, workmanship, responsiveness, or project performance. Any construction contract is between the homeowner and the contractor. Homeowners should independently verify qualifications, insurance, references, scope, and pricing before approving work.
6. Your information and submissions
You agree to provide accurate information and have the right to submit any photographs or other content you upload. You retain your ownership rights in original content and grant Mapquo a nonexclusive, royalty-free license to host, process, reproduce, and transmit it as reasonably needed to operate the services, generate estimates, support users, and deliver the request to your selected contractor. This does not authorize unrestricted public marketing use of your photographs. See our Privacy Policy at https://mapquo.com/privacy.
7. Third-party maps
Google Maps Platform features are subject to applicable Google terms, including https://maps.google.com/help/terms_maps/ and https://policies.google.com/privacy. Google retains rights in its map content. Users may not scrape, extract, redistribute, or otherwise misuse mapping content. Mapquo does not promise third-party map accuracy or availability.
8. Contractor accounts and pricing
Contractors must provide accurate pricing configurations, business details, service offerings, and account information; verify real job conditions; safeguard homeowner leads; and comply with relevant construction, privacy, consumer, and advertising laws. Contractors may use homeowner lead details to respond to the requested quote, discuss and follow up on that project, prepare a proposal, and manage an actual resulting customer relationship. They must not sell leads, share them with unrelated marketers, or use quote submissions for unrelated promotions without a separate lawful basis and any required consent. Contractors may cancel a subscription at any time using the cancellation method provided in the applicable checkout, billing process, or Contractor Service Agreement. Unless different lawful terms were expressly agreed, cancellation stops future renewals and paid access continues through the end of the current paid billing period; unused time is not automatically refundable. Prices, billing cycles, automatic renewal disclosures, payment authorization, refunds, and any legally required additional terms must be presented before payment. If access is ended for cause or affected by unpaid fees, the applicable agreement and law control. Subscription fees are for software access, not guaranteed leads or project revenue. A separately executed Contractor Service Agreement controls in case of conflict on contractor-specific commercial terms.
9. Website links and permitted branding
During an active authorized subscription, contractors may display a Mapquo-approved call-to-action button or link on their own website that directs homeowners to the contractor-specific Mapquo quote page. This permission is limited, nonexclusive, nontransferable, and ends when authorization or the applicable subscription ends. Contractors may not materially alter the approved link or mark, misrepresent ownership of Mapquo technology, remove required attribution or legal notices, or imply that Mapquo performs the construction work. Embedding Mapquo in an iframe or integrating through an API is not authorized unless Mapquo separately approves it in writing.
10. Customer communications and permissions
Mapquo may send estimate receipts and related operational emails necessary to fulfill a quote request. Contractors are independently responsible for the legality of their subsequent calls, emails, and texts, including required consent, accurate identification, suppression and opt-out requests, and maintaining records where applicable. A homeowner quote request is not blanket authorization for unrelated marketing or automated promotional telephone and text campaigns. Mapquo may separately offer optional marketing subscriptions only in accordance with applicable consent and unsubscribe requirements.
11. Contractor and homeowner disputes
Disputes concerning contractor workmanship, property damage caused by construction, scheduling, on-site project measurements, final contractor pricing, contractor payment demands, or a construction warranty should ordinarily be addressed between the homeowner and the responsible independent contractor. Mapquo does not arbitrate or guarantee the outcome of those disputes. Nothing here excuses Mapquo from responsibility for its own conduct to the extent required by law or limits nonwaivable consumer remedies.
12. Acceptable use
You may not submit fraudulent requests, impersonate others, upload unlawful content, misuse customer data, scrape mapping content, interfere with systems, bypass security restrictions, introduce malicious code, or access another user’s information without authorization. Mapquo may suspend access for legitimate security, legal, or material compliance reasons.
13. Intellectual property
Mapquo and its licensors own the software, website design, trademarks, and other intellectual property comprising the services. Users receive only the limited right to use the services in accordance with these Terms. Contractors retain rights in their independently owned brands and materials, while third-party content remains subject to its owners’ terms.
14. Availability and disclaimers
We may modify features and perform maintenance. Service availability can be affected by third-party infrastructure. To the fullest extent allowed by law, the services are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not warrant that calculations, measurements, maps, or estimate ranges will be accurate or uninterrupted, or that a contractor will respond, accept, or complete a project. Nonwaivable legal rights remain unaffected.
15. Limits of liability
To the fullest extent permitted by law, Mapquo LLC and its representatives are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the services, including lost business, lost profits, or reliance on preliminary estimates. To the extent lawful, total aggregate liability for a paying contractor claim is limited to fees paid or payable for the services during the 12 months preceding the claim; for nonpaying users, it is limited to $100. These limits do not restrict liability that cannot legally be limited.
16. Business-user indemnification
To the extent allowed by law, contractors and other business users agree to defend and indemnify Mapquo against third-party claims resulting from their unlawful conduct, material breach of these Terms, infringement, or their independent construction services. Homeowners are not responsible for a contractor’s separate conduct merely because they requested an estimate.
17. Termination
Homeowners may stop using Mapquo at any time. We may restrict or suspend use for security issues, fraud, unlawful conduct, or material violations of these Terms. Paid contractor cancellation and termination rights are governed by applicable subscription terms and law. Records may be retained as provided in our Privacy Policy and applicable law.
18. Michigan law and disputes
These Terms are governed by Michigan law except where mandatory laws otherwise apply. Subject to applicable law, disputes may be brought in a court of competent jurisdiction in Michigan. Nothing here removes consumer rights that cannot be waived.
19. Changes and general provisions
We may revise these Terms by posting an updated version and providing additional notice or obtaining agreement when legally required. If any provision is unenforceable, the rest remain in effect to the extent permissible. Failure to enforce one provision is not a waiver. Separate contractor agreements govern their specific commercial terms when inconsistent with these general Terms.
